𝐑𝐈𝐄𝐊 𝐌𝐀𝐂𝐇𝐀𝐑 𝐀𝐍𝐃 𝐒𝐄𝐕𝐄𝐍 𝐎𝐓𝐇𝐄𝐑 𝐒𝐏𝐋𝐌/𝐀—𝐈𝐎 𝐃𝐄𝐓𝐀𝐈𝐍𝐄𝐄𝐒 Juba, July 29, 2026 — The SPLM-IG-established sham court, known as the Special Court on the Incident of Nasir, which is targeting leaders and members of the SPLM/A-IO, notably First Vice President Dr. Riek Machar, held its 102nd session this morning at its usual venue—Freedom Hall. During today’s session, the fourth accused, Lt. Gen. Gabriel Duop Lam—Acting Chief of Staff of the SPLA-IO, Co-Chair of the Joint Defense Board (JDB) and Deputy Chief of the Defense Forces of the SSPDF—resumed his defense testimony in the ongoing, politically and tribally motivated trial regarding the Nasir incident (Case No. 15533/2025) from where he left off during the previous session. Meanwhile, a key accused person was absent due to illness. 𝐆𝐞𝐧𝐞𝐫𝐚𝐥 𝐆𝐚𝐛𝐫𝐢𝐞𝐥 𝐃𝐮𝐨𝐩 𝐋𝐚𝐦’𝐬 𝐓𝐞𝐬𝐭𝐢𝐦𝐨𝐧𝐲 Addressing allegations that he leaked classified information to unauthorized entities, Lt. Gen. Duop Lam clarified the nature of his communication with the U.S. Ambassador, emphasizing his official capacity under the Revitalized Peace Agreement: “Lastly, based on the mandate provided by the Revitalized Peace Agreement, Chapter VII, Articles 7.2, 7.2.4, and sub-article 7.2.4.4—where Article 7.2 outlines the membership of the Reconstituted Joint Monitoring and Evaluation Commission (RJMEC)—the commission comprises representatives of the parties to the Peace Agreement, other South Sudanese stakeholders, regional and international guarantors, and partners of South Sudan, including the United States representative. In my official capacity, I am an interlocutor with the RJMEC, serving as co-chair of the Joint Defense Board (JDB) and Acting Chief of General Staff of SPLA(IO).” Addressing claims that discussions with foreign diplomats constituted security breaches, he clarified the public nature of the shared documentation: “Against this background, we shared matters related to the Peace Agreement with our peace partner, the US Ambassador. This was not a breach of national security protocols or the unauthorized transfer of confidential correspondence to a foreign diplomat. After all, the document was copied to the Troika (U.S.A., Norway, and U.K.) and is also a public document.” Regarding the third charge—which alleges a failure to notify the SSPDF command of an imminent attack on the Wich-Yar-Adiu garrison in Nasir—Lt. Gen. Duop Lam clarified the command structure and emphasized the non-involvement of SPLA-IO forces: “Charge (c): That I failed to inform the SSPDF command about an imminent attack by the armed youth and SPLA-IO. Regarding this charge, let me make it clear once again that the SPLA-IO did not participate in the attack on the Wich-Yar-Adiu garrison in Nasir. Concerning the allegation of failing to inform the SSPDF command about an imminent attack on the SSPDF garrison of Wich-Yar-Adiu, I must ask: who constitutes that SSPDF command? To me, there is no difference between the SSPDF command and me; we are part of the same command structure that receives field reports from divisional commanders whenever security tensions arise. Besides the division commanders, we also receive security reports through our military intelligence officers assigned to the divisions. Regarding the situation in Nasir, we were all notified by the late Maj. Gen. David Majur Dak and the intelligence officer in charge. Above all, civilians—whether armed or not—are not under the command of the SPLA-IO.” Addressing the fourth charge, which concerns an alleged communication to procure PKM machine gun ammunition from Lt. Col. Marko on December 10, 2024, the general acknowledged the offer but emphasized that no purchase was executed: “Charge (d): That I was involved in arms and ammunition procurement discussions with Lt. Col. Marko on December 10, 2024, where Lt. Col. Marko offered me 500 rounds of PKM machine gun ammunition at 3,500 SSP per bullet, and that I acknowledged the message. (Pages 5–7, paragraphs 41–71 of my individual report; and page 3, paragraphs 29–31; page 14, paragraph 254; page 17, paragraphs 354–358; and page 24, paragraphs 576–577 of the main report.) Yes, there was an attempt by Lt. Col. Marko to sell me 500 rounds of PKM machine gun ammunition for my personal weapon, but I did not purchase the ammunition because I did not need it, in accordance with Section 78(c)(f) of the SPLA rules and regulations of 2009. Furthermore, this issue has no connection whatsoever to the Nasir incident, contrary to the claims of the prosecutors and prosecution witness No. 13, digital forensic expert Mr. Peter Rafadi Calvin, in the pages mentioned above.” Charge Five accuses Lt. Gen. Duop Lam of maintaining unauthorized contact with Accused No. 7 (Lt. Mading Yak Riek) to gather intelligence on troop and barge movements, including SMS updates received on March 1, 2025: “Charge (e): That I maintained regular communication with Accused No. 7 (Lt. Mading Yak Riek), from whom I received details of operations and intelligence regarding SSPDF troop and barge movements. Additionally, on March 1, 2025, I received a short message service (SMS) update from the radio operator and Accused No. 7 regarding shelling activities and a request for gunship support near Doma, as well as a message about the arrival of SPLA-IO forces at Khor Guen, where Maj. Gen. Peter Gatwech Gai was located. (Page 2, paragraphs 9–13; page 4, paragraphs 35–37; and pages 8–12, paragraphs 72–114 of my individual report. Page 3, paragraphs 26–27; page 15, paragraphs 267–268; page 17, paragraphs 359–363; and page 21, paragraphs 465–479 of the main report.)” In response, Lt. Gen. Duop Lam outlined the official setup of long-range radio operations in Juba under the peace deal context: “In response to these fabricated charges: First, the SPLA-IO maintains a radio operator in Juba in line with the implementation of the Revitalized Peace Agreement. The presence of this long-range radio communication and the assignment of the radio operator were not a secret plan by the SPLA-IO; the security unit in the office of the 1st Vice President shared these matters with the security unit in the office of H.E. the President. The objective of this radio was to coordinate security arrangement activities between the SPLA-IO cantonment sites in the field and General Headquarters (GHQ). The primary duty of the radio operator is to transmit and receive all communication messages from SPLA-IO units and subsequently deliver the information to the concerned authorities.” He further detailed the military distinction between classified operational data ("live information") and public updates ("dead information"): “Your Lordships, generally, in security departments, there are two types of security information: * Live information – These are sealed operational plans within the security sector, which are classified and require restricted knowledge. * Dead information – These are breaking events that have already occurred and serve as news for public consumption. The movement of SSPDF gunboats initially appeared to be a peaceful mission under live information, but when the SSPDF gunships and helicopters initiated aerial bombardments in Doma village, the subject shifted into dead information. Again, let me make it crystal clear that I did not task our radio operator, 1st Lt. Mading Yak Riek, with monitoring the intelligence or movement of SSPDF barges and troops to Nasir. This is entirely untrue. Any messages that I received came through official SPLA-IO radio transmitters.” Lt. Gen. Duop Lam clarified the sixth charge, which alleged that he improperly opposed the transfer and relief of SSPDF forces in Nasir during command meetings at Bilpam Army Headquarters: “Charge (f): That I opposed the transfer and relief of overdue SSPDF forces in Nasir unless they were replaced with the Necessary Unified Forces during one of the official command meetings at the Bilpam army headquarters, as stated by the SSPDF reporter. I opposed the Chief of Defense Forces (CDF) in an official meeting, which is my right, especially when we were discussing a previous command resolution that ordered the transfer of one battalion of the Necessary Unified Forces to Nasir. It is to be noted that the army command meeting is the forum where commanders express their opinions—including myself, as the Deputy Chief of Defense Forces. See SPLA rules and regulations of 2009, Section 49, on administrative methods for units. Furthermore, it is my right to defend the decision made by the Joint Defense Board (JDB) regarding the deployment of the Necessary Unified Forces to Nasir. The JDB is entrusted with the command and control of all forces belonging to the signatories of the R-ARCSS. It is the JDB that deploys forces in accordance with Articles 2.4.2 and 2.2.1 of the Peace Agreement, read together with Articles 151(1), (2), 153(2), 154-A, and 201(B)(7), (😎 of the Constitution, as amended.” Addressing digital forensic testimony regarding alleged digital records extracted from his phone, Lt. Gen. Duop Lam stressed that all messages were routine operational communications and called for forensic verification: “Charge (g): In response to prosecution witness No. 13—the digital expert—regarding the records extracted from my Samsung Galaxy Note 20 phone: Communication between myself and Lt. Mading Yak Riek was official and routine, while communication with Michael Adler was official because he is a peace interlocutor with the RJMEC. Your Lordships, during the cross-examination of witness No. 13 by defense lawyer Anis Tombe, I heard him say, "I thank God because Mr. Gabriel Duop Lam did not delete his WhatsApp conversations." My Lords, I did not delete any of my messages simply because they constituted official work. On the contrary, I should be the one to thank God instead, because Mr. Calvin Rafadi failed to delete the original messages (hash values), which exposed him to extensive questioning from defense lawyer Dr. Geri Rimondo, who requested him to produce the exact hash values for the other five accused persons. During the same session, the expert went so far as to thank the court for ruling out the demand to check the accused persons' phones to ascertain their original messages. So, my Lords, I pray that we still have an opportunity to examine our phones in the interest of justice and fairness, even though I know the court ruled against this previously.” Responding to testimony from protected witness No. 8—who claimed that Duop Lam ordered Lt. Gen. Peter Thok Chuol to block barges and hold public rallies—the General presented an alibi regarding Commander Thok's whereabouts: “Charge (h): In response to the testimony made by the prosecution's protected witness No. 8 stating that Lt. Gen. Gabriel Duop Lam communicated with Lt. Gen. Peter Thok Chuol in Mandeng and ordered him not to allow the barges to go to Nasir. The witness further stated that Peter Thok also moved from Mandeng to Ulang, where he conducted public rallies with the local population, warning that if the barges were allowed to reach Nasir, the SSPDF would deploy to five locations: Doma, Ulang, Yomding, Nasir, and Borebiey. This statement from witness No. 8 is completely false. Lt. Gen. Peter Thok Chuol was granted medical leave by the Commander-in-Chief of the SPLA-IO, H.E. Dr. Riek Machar, to seek eye treatment in Addis Ababa, Ethiopia, beginning in January 2025, and he remains in Ethiopia. The Nasir incident happened in his absence. The Nuer protected witnesses who appeared in court may have been coached to testify against certain individuals at the directives of the prosecution. Furthermore, I never communicated with Commander Peter Thok throughout the entire period of his treatment in Ethiopia.” Concluding his defense statement today, Lt. Gen. Gabriel Duop Lam, rejected the prosecution's overarching theory presented on September 29, 2025, which alleged that SPLM/A-IO high-ranking political and military leaders coordinated and funded the assault on the Nasir garrison: “Charge (i): Your Lordships, on September 29, 2025, during the prosecution's opening speech (page 3, paragraph 5, and page 4, paragraph 6), it was clearly stated that the local youth who attacked the Nasir garrison did not act independently; rather, they were under the direct command of the fourth accused, Lt. Gen. Gabriel Duop Lam; Maj. Gen. Dhiling Keak, who is at large; and the fifth accused, Dr. Riek Machar Teny-Dhurgon, financed by the first accused, Hon. Puot Kang Chol, and the second accused, Mam Pal Dhuor. The prosecution stated further that the attack by the local youth was well planned, funded, coordinated, and commanded by several SPLA-IO commanders in Juba. The assault coordinators were Lt. Gen. Gabriel Duop Lam and Maj. Gen. Dhiling Keak, while the commanding SPLA-IO officers on the ground in Nasir were the late Tor Gile Thoan, Kang Makana, Lt. Gen. Peter Thok Chuol, Brig. Gen. Manpiny Pal, Brig. Gen. Pal Mut Nyoach, Bol Dayak, and Maj. Gen. Koang Manyong.” Hon. Puot Kang Chol, Minister of Petroleum and the first accused in this politically and tribally motivated trial, missed today’s session due to illness. We wish him a speedy and full recovery, as well as good health for all SPLM/A-IO detainees. The Sham Court adjourned proceedings until Monday, August 3, 2026, when General Gabriel Duop Lam is expected to continue presenting his defence testimony. The SPLM/A (IO) continues to vigorously reject the so-called "Special Court", considering it a tool to abrogate the Revitalized Agreement and target H.E. Dr. Riek Machar and the SPLM/A (IO) through a perceived political witch-hunt. The movement reiterated its demands for the immediate and unconditional release of H.E. Juba, July 27, 2026 — The sham court held its 101st session at Freedom Hall. The court directed H.E. Dr. Riek Machar to remove his necktie in a further act of humiliation, while Lt. Gen. Gabriel Duop Lam (4th accused) continued his defence testimony detailing SSPDF ceasefire violations in Western Equatoria, his unlawful detention, a stroke suffered during proceedings, and a full rebuttal of all charges. The SPLM/A-IO rejects the Special Court and demands the immediate and unconditional release of all detainees.
